Deputy Town Attorney / Prosecutor (Part-Time)Town of West Seneca, New York

Nature of Appointment

This position is a part-time professional appointment made by resolution of the Town Board of the Town of West Seneca pursuant to New York State Town Law. The Deputy Town Attorney / Prosecutor serves at the pleasure of the Town Board and under the general direction of the Town Attorney.

Statement of Duties

The incumbent assists the Town Attorney in providing legal services to the Town and represents the Town in prosecutorial matters. Duties may include, but are not limited to:

• Prosecuting violations of the New York State Penal Law, Vehicle and Traffic Law, and local laws and ordinances in Town Court.
• Appearing in Town Court for arraignments, hearings, trials, motions, and related proceedings.
• Preparing legal pleadings, motions, briefs, and other prosecutorial documents.
• Conducting legal research and providing legal analysis as directed by the Town Attorney.
• Advising Town officials, departments, boards, and commissions on legal matters as assigned.
• Attending Town Board meetings, court sessions, and other meetings as required.
• Coordinating with law enforcement agencies, court personnel, and outside counsel.
• Performing related duties as required or assigned by the Town Attorney.

Minimum Qualifications

• Graduation from a law school accredited by the American Bar Association with a Juris Doctor (J.D.) degree.
• Admission to practice law in the State of New York and membership in good standing with the New York State Bar.
• Ability to perform the essential functions of the position with or without reasonable accommodation.

Preferred Qualifications

• Prior experience in municipal law, criminal prosecution, or public sector litigation.
• Experience appearing in Town or Village Court.
• Knowledge of New York State Penal Law, Vehicle and Traffic Law, Criminal Procedure Law, and municipal governance.

Civil Service Status

This position is anticipated to be classified as Non-Competitive or Exempt , subject to review and approval by the appropriate Civil Service agency. Appointment is contingent upon Civil Service determination, where applicable.

Work Schedule

This is a part-time position . Work hours are variable and based on operational needs, including scheduled Town Court sessions and meetings. Evening hours may be required.

Compensation

Annual part-time salary: $15,300, consistent with the Town’s adopted budget.

Term of Appointment

The Deputy Town Attorney / Prosecutor serves at the pleasure of the Town Board and may be removed in accordance with applicable law.
